Last updated October 2026

§1 Scope

These General Terms and Conditions (hereinafter "T&C") apply to all contracts concluded between Racentis — Martin Ihnow (hereinafter "Seller") and the buyer (hereinafter "Customer") through the Seller's online shop.

Deviating, conflicting or supplementary general terms and conditions of the Customer shall not become part of the contract, even if known, unless their validity is expressly agreed to in writing.

These T&C apply to both consumers and businesses, unless a distinction is made.

Note: Consumers within the meaning of these T&C are natural persons pursuant to § 13 of the German Civil Code (BGB), who act for purposes that are predominantly outside their trade, business or profession.

§2 Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order (invitatio ad offerendum).

The Customer may select the Seller's products without obligation and collect them in a shopping cart. By clicking the order button, the Customer submits a binding offer to purchase the goods in the shopping cart.

The Seller may accept the Customer's offer within 2 days by sending an order confirmation by email or by delivering the ordered goods.

If the "Advance payment" method is selected, the Customer undertakes to transfer the invoice amount within 5 working days after conclusion of the contract. Shipping takes place after receipt of payment.

The right of withdrawal does not apply to contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. The same applies to goods that are made to the Customer's specifications (custom-made products).

To exercise the right of withdrawal, the Customer must inform the Seller of the decision to withdraw from this contract by means of a clear statement (e.g. by email to info@racentis.com).

Note on custom-made products: For products made to the Customer's specifications (e.g. printed items with an individual design), there is no right of withdrawal pursuant to § 312g (2) no. 1 of the German Civil Code (BGB).

§6 Retention of title

The delivered goods remain the property of the Seller until the purchase price has been paid in full (retention of title).

The Customer is obliged to treat the goods subject to retention of title with care. In particular, the Customer is obliged to insure them adequately at replacement value against fire, water and theft damage at their own expense.

The Customer must inform the Seller in writing without delay of any seizure or other interference by third parties, so that the Seller can take the necessary measures.

§7 Warranty & Liability for defects

The statutory warranty rights apply. The warranty period for consumers is 2 years from delivery of the goods.

In the event of a defect in the purchased item, the Customer is initially entitled to subsequent performance (repair or replacement at the Seller's choice). If subsequent performance fails, the Customer may, at their choice, reduce the purchase price or withdraw from the contract.

Obvious damage or defects must be reported in writing within 7 days of receipt of the delivery.

Statutory warranty period: 2 years
Right to subsequent performance: repair or replacement
If subsequent performance fails: price reduction or withdrawal
Notice of obvious defects: within 7 days

§8 Limitation of liability

The Seller is liable to the Customer in all cases of contractual and non-contractual liability in the event of intent and gross negligence in accordance with the statutory provisions for damages or reimbursement of futile expenses.

In other cases, the Seller is only liable — unless otherwise stipulated in this clause — for breach of a contractual obligation whose fulfilment is essential for the proper performance of the contract and on whose compliance the Customer may regularly rely (so-called cardinal obligation), and limited to compensation for foreseeable and typical damage.

The above limitations of liability do not apply in the event of injury to life, body or health, for a defect after assumption of a quality guarantee, or in the event of fraudulently concealed defects. Liability under the German Product Liability Act remains unaffected.

Important: The limitations of liability also apply in favour of the Seller's vicarious agents if claims are asserted directly against them.

§9 Data protection

The Seller collects, processes and uses the Customer's personal data exclusively for the processing of the purchase contract and for maintaining the customer relationship. Data is only passed on to third parties to the extent necessary for the fulfilment of the contract (e.g. transfer of the address to the shipping service provider).

For further information, please refer to the separate privacy policy available on the Seller's website.

§10 Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR), available at https://ec.europa.eu/consumers/odr.

The Seller is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Note pursuant to § 36 VSBG: We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§11 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.

If the buyer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the Seller's place of business.

Should individual provisions of these T&C be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The statutory provision shall replace the invalid provision.

The Seller reserves the right to amend these T&C at any time with effect for the future. The current version is available on the Seller's website.
